Emergency Protective Order (EPO) Attorney Lexington KY

Kentucky EPO Attorney, How to get an EPO in lexington KY, kentucky emergency protective order laws, best Kentucky EPO attorney near me, How long does it take to get an EPO in Kentucky, free Kentucky EPO legal consultationLexington KY Attorney Breck Norment is experienced in helping clients enter an EPO.
In Lexington, Kentucky, an EPO (Emergency Protective Order) is a court order granting immediate relief when a person has faced domestic violence or when a person has faced the threat of domestic violence. The person requesting relief is known as the "petitioner" and the person committing domestic violence or the threat of domestic violence is the "respondent."  Essentially, the order will set forth various methods of immediate protection for the petitioner against the respondent.  For example, the order may require the respondent to stay more than 500 feet away from the petitioner's home or the couple's children.  Additional information regarding EPOs can be found here:  http://www.fayettesheriff.com/epo.html.

In Kentucky, almost any person can apply for an EPO.  In most cases, a judge is likely to grant the EPO because EPOs are limited based on the time constraints of the order.  Within 14 days, the judge must hold a hearing to determine whether he or she will grant a Domestic Violence Order (DVO).

Kentucky judges also routinely grant EPOs due to the danger of fostering future domestic violence (and other more serious offenses) if the EPO is not granted.  In other words, it is safer, easier, and smarter to grant an EPO to prevent future violence than it is to deal with future violence after the fact.  Kentucky courts are protecting the petitioner from the respondent's threat of domestic violence, but they are also protecting the respondent from committing a more serious offense and winding up with criminal charges.

The easiest place to apply for an EPO is the district courthouse, but you may be able to do so at other locations (such as a police station) as well.  Ask around, and someone will walk you through the process of filing a petition.  You will need to fill out some forms setting forth the reasons you are requesting relief.  Many individuals file the petition on their own, but Lexington, KY divorce lawyer Breck Norment would be happy to assist if you need help.  Mr. Norment is well-versed in the laws regarding EPOs and DVOs, and he would be able to walk you through the process with confidence.  Mr. Norment would also work his hardest to achieve the results you need in the courtroom.
